Eastern Iowa Construction Limited Labor Warranty

Limited Labor Warranty

Limited Warranty: Eastern Iowa Construction LLC. (E.I.C.) warrants to you, the original owner of its roofing system, which the roofing system is free from installation defects which results in leaks.

The limited warranty is the sole and exclusive remedy, and during the warranty period specified, the maximum repair or replacement cost to E.I.C. shall not exceed during the warranty period, the replacement cost to the owner for the product plus replacement application cost.

Sole Warranty:   THE LIMITED WARRANTY SET FOR THE HEREIN IS EXCLUSIVE AND LIMITS AS TO DURATION ALL OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED BY LAW INCLUDING THE IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE TIME PERIODS STATED.  E.I.C... E.I.C.’S LIABILITY IS LIMITED TO THE PROVISIONS OF THE LIMITED WARRANTY, WHETHER ANY CLAIM AGAINST IT IS BASED  UPON STRICT LIABILITY, NEGLIGENCE, BREACH OF WARRANTY OR ANY OTHER THEORY OR CAUSE OF ACTION.  NO PERSON IS AUTHORIZED TO ALTER THIS LIMITED WARRANTY EITHER OR ALL OR IN WRITING.

Limits of Coverage (what is not covered): E.I.C. shall not be liable for and the Limited Warranty set forth herein does not apply to:

a.       ANY ROOFING SYSTEM THAT IS NOT PAID FOR IN FULL WITHIN 10 DAYS OF COMPLETION.

b.    DAMAGE TO THE ROOFING SYSTEM CAUSED BY INADEQUATE ATTIC/ROOF SHEETING VENTILATION (NOTE: Ventilation must meet the FHA and HUD Minimum Property Standards or a minimum of one(1) square foot free venting area per 150 square feet of attic floor area, whichever provides the most ventilation);

c.       Damage to a roof system due to settlement, distortion, failure or cracking of the roof deck, walls or foundation of a building or to any defect in or failure of a roof base over which products are applied or for damage by foot traffic on the roof;

d.       Damage from any cause other the inherent installation defect;

e.       Acts of God including lighting, hurricane, tornado, hailstorm, impact of foreign objects or other violent storms;

f.        Claims by owners or transferees not qualifying as Original Owners or Authorized Transferees under this Limited Warranty.

g.       Any roof system that has been altered in any way by anyone other than an E.I.C. certified roofing system installer.

TRANSFERABILITY:  The original owner may transfer this warranty to the subsequent owner, with the following limitation: For transfer of this warranty during the warranty period, the remaining time available on the warranty for the owner will be the same as for the original owner.  The Second owner MUST NOTIFY E.I.C. IN WRITING WITHIN 30 DAYS after the real estate transfer for any coverage to be transferred again.  That is, the purchaser of your home may not transfer with this warranty to any subsequent purchasers.  The cost of transfer is $35.00.

CLAIM REPORTING PROCEDURE: Any claim made here under must be made within seven (7) days after discovery of the alleged defect by calling 1-877-552-ROOF or in writing to:

To fully evaluate your claim we may ask you to provide and forward, at your expense, pictures of your roof system for us to evaluate.  Repairs made prior to or during the investigation period without Eastern Iowa Construction, LLC’s prior approval shall be at the owner’s expense.  With all claims, the original proof of purchase must be submitted with any other claim information requested.

 WARRANTY NOT VALID IF INFORMATION IS ERRONEOUS.

This warranty is effective on all roofing systems installed in the United States on and after 1/1/04
